TERMS & CONDITIONS (General Terms and Conditions)

1. Scope of Application

These Terms and Conditions (“T&Cs”) apply to all sales of goods by Unrelate Club Handels KG, Weerer-Eben 11d, 6116 Weer, Austria (“we”, “us”) to customers (“customer”, “you”) via our online shop at www.unrelateclub.com.

Any terms and conditions of the customer that conflict with or deviate from these T&Cs shall not be recognized unless we have expressly agreed to their validity in writing.

2. Consumers and Business Customers

Some provisions of these T&Cs apply exclusively to consumers or exclusively to business customers.

A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

A business customer is any natural or legal person acting in the exercise of their commercial or independent professional activity when concluding a contract.

3. Customer Account

Customers may create a personal account. Login credentials must be kept confidential.

In case of loss, misuse, or unauthorized access, the customer must notify us immediately.

4. Conclusion of Contract & Language

By placing an order, you submit a binding offer to conclude a purchase contract.

We accept this offer within two (2) business days by:

  • sending an order confirmation email, or

  • dispatching the goods

The contract language is German.

5. Storage of Contract Data

Order data and these T&Cs are stored by us. Customers may print or save this information.

An order summary is available during checkout and in the order confirmation email.

6. Delivery & Shipping

We deliver worldwide, including the European Union, the United States, and other international destinations.

All products are made to order. Production begins after purchase, which may result in extended delivery times.

Estimated delivery times:

  • Austria: 7–14 business days

  • EU: 10–18 business days

  • International (including USA): 14–25 business days

Shipping costs are displayed during checkout.

Delays due to customs processing or local import regulations may occur and are beyond our control.

7. Payment

Payments are due immediately upon conclusion of the contract.

Accepted payment methods are displayed during checkout.

As a small business, no VAT is charged in accordance with § 6 (1) no. 27 Austrian VAT Act (Kleinunternehmerregelung), if applicable.

8. Retention of Title

Goods remain our property until full payment has been received.

The customer is entitled to resell the goods in the ordinary course of business. Any resulting claims are hereby assigned to us.

9. Warranty (Defects Liability)

Statutory warranty rights apply.

For consumers, the statutory warranty period is two (2) years from delivery.

Defects must be reported in writing without undue delay after discovery.

For business customers, statutory provisions apply with the possibility of shorter limitation periods where legally permissible.

10. Liability

We are liable without limitation for intent and gross negligence.

For slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable and contract-typical damages.

We are not liable for indirect damages, loss of profit, or consequential damages caused by slight negligence.

11. Use of Technologies

Product designs and content may partially be created or supported using AI-based technologies. Final design selection, editing, and approval are performed by our team.

12. Customer Reviews

We reserve the right to remove reviews that are unlawful, defamatory, discriminatory, misleading, or unrelated to the product experience.

13. Right of Withdrawal / Returns

13.1 European Union / EEA Customers (Right of Withdrawal)

Consumers within the European Union/EEA have a statutory right of withdrawal of fourteen (14) days in accordance with applicable EU consumer protection law.

The withdrawal period begins on the day the consumer receives the goods.

To exercise the right of withdrawal, the customer may inform us of their decision to withdraw from the contract by an unequivocal statement (e.g. by email or through the withdrawal form provided on our website).

The use of a withdrawal button or online withdrawal function, where provided on our website, constitutes an additional and convenient way to exercise this right but is not a substitute for the statutory requirements unless explicitly required and implemented by applicable law.

13.2 United States & International Customers (outside EU/EEA)

For all orders shipped outside the European Union (including the United States and all other international destinations), no statutory right of withdrawal applies.

Returns are only accepted in the following cases:

  • the item is defective

  • the item is damaged upon arrival

  • an incorrect item was delivered

In such cases, the customer must contact us immediately upon receipt, including photographic evidence.

13.3 General Return Conditions

All returned items must be:

  • unworn and unused

  • in original condition

  • with all tags attached

  • in original packaging

Return shipping costs are generally borne by the customer, unless otherwise required by mandatory law.

The return address is provided individually after approval of the return request.

14. Governing Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, mandatory consumer protection laws of their country of residence remain unaffected.

15. Jurisdiction

For contracts with business customers, the place of jurisdiction is the registered office of the company in Austria.

For consumers, statutory jurisdiction rules apply.

We reserve the right to bring claims at the customer’s place of residence.
